Important: This webpage provides general guidance for conditional licensees and applicants selected in the 2024 lottery regarding the pathway to licensure. The information provided is intended to assist applicants in preparing for licensure but does not replace or supersede Maryland statute, regulation, or formal MCA determinations.
Each licensee’s circumstances are unique, and additional documentation or review may be required depending on ownership structure, financing arrangements, or operational model.
The Maryland Cannabis Administration (MCA) is committed to supporting conditional licensees as they move from conditional approval to final licensure and authorization to operate. This information is intended to provide general guidance on the MCA’s processes and expectations. Nothing contained herein is intended to be exhaustive or to exclude any information that the MCA may request in order to make a determination on a license application. MCA reserves all rights to require additional documentation or information from any license applicant.
Guidance for Conditional Licensees:
This webpage provides guidance and materials to help applicants understand the Pathway to Licensure, the required steps in the process, and key documentation expectations.
The materials provided here reflect the general pathway conditional licensees must complete to receive final licensure and operational approval. While this guidance is intended to assist applicants in preparing for each phase of the process, it does not replace statutory or regulatory requirements.
The Pathway to Licensure consists of five phases:
1. Supplemental Application Submission
2. Location Review
3. Facility Review
4. Pre-Licensing Readiness
5. Final Licensure and Authorization to Operate
More details about the requirements of the process can be found in this visual overview along with links to supporting materials associated with each phase.
Applicants are encouraged to review all materials on this page carefully and begin preparing documentation early to avoid delays.
Materials and Resources
The following materials are available to help licensees prepare for each stage of the licensure process.
These materials are intended to provide clarity regarding required steps, documentation expectations, and common challenges that may impact timelines.
Important Considerations for Conditional Licensees
The following information is provided to help applicants set appropriate expectations as they progress through the pathway to licensure.
Corporate Documentation Review
- Corporate documents related to ownership, financing, governance, or management must be submitted and reviewed prior to scheduling a Pre-Licensing Inspection.
- Review timelines vary depending on the complexity and completeness of the submission, but licensees should anticipate review periods that may take approximately 30 days.
- Incomplete or revised submissions may extend review timelines up to 60 days.
Management Agreements
- Management Agreements or Management Services Agreements (MSAs) are subject to a separate approval process.
- Submission of an MSA does not constitute approval. Applicants should ensure that any proposed Management Agreement is submitted for review prior to implementation.
Additional Requirements May Apply
- Depending on your license type, business model, financing structure, or operational plan, MCA may request additional documentation or clarification during the review process.
- Applicants should be prepared to respond to follow-up questions or provide supplemental materials.
Planning and Project Timelines
Conditional licensees are encouraged to plan carefully and build reasonable timelines into their business plans. Development of a licensed cannabis facility often involves:
- Local zoning and permitting approvals
- Facility design and buildout
- Security system installation
- Equipment procurement
- Workforce development
- Operational policy development
These processes frequently occur concurrently with MCA review timelines.
Completeness of Submissions
- Submitting complete and well-organized documentation significantly improves review efficiency.
- Incomplete submissions, missing documentation, or materials requiring revision may delay progression through the pathway.
- Applicants should carefully review all guidance and checklists prior to submission.
Regulatory Compliance
- All applicants and licensees remain responsible for complying with applicable Maryland statutes, regulations, and MCA guidance throughout the licensure process.
- Materials provided on this webpage are intended as informational guidance and do not supersede statutory or regulatory requirements.
Common Reasons Licensure Progress May Be Delayed
While many licensees move through the pathway efficiently, delays most commonly occur when required documentation is incomplete or when business structures change during review.
Examples of common delays include:
- Incomplete ownership documentation
- Undisclosed financing arrangements
- Changes to ownership or control during review
- Unapproved management agreements
- Incomplete facility buildout prior to inspection
- Security systems not meeting regulatory requirements
- Local zoning or permitting issues
- Required operational policies have not yet been developed
Applicants are encouraged to review guidance materials carefully and ensure documentation is complete prior to submission.
What MCA Can and Cannot Do
To ensure fairness and regulatory consistency, MCA must follow established statutory and regulatory processes.
MCA Can:
- Provide information regarding the licensure process
- Review submitted documentation and provide feedback
- Identify deficiencies that must be corrected prior to approval
- Conduct facility inspections
- Approve licenses once all regulatory requirements are satisfied
MCA Cannot:
- Expedite individual applications outside established processes
- Approve incomplete submissions
- Provide legal or business consulting services
- Waive statutory or regulatory requirements
- Approve unreviewed ownership or financing structures
